    1. Introduction

    Hitchens Enterprises, LLC, doing business as Aquapio (“Aquapio,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit [aquapio.com] (the “Site”) or use the Aquapio customer-relationship-management platform and related services (collectively, the “Service”).

    Aquapio is a CRM and business-automation platform for the manufactured housing industry. This Policy applies to (a) visitors to our Site, (b) our business customers and their authorized users (“Customers”), and (c) individuals whose information our Customers process through the Service (“End Users”), subject to Section 11 below.

    2. Our Two Roles: Business and Service Provider

    When we act as a business. For information we collect about our Site visitors and our own Customers (such as account and billing information), Aquapio acts as a “business” (controller) and this Policy governs how we handle that information.

    When we act as a service provider. When our Customers use the Service to manage their own contacts, leads, students, and clients, those Customers control that End User data. For that data, Aquapio acts as a “service provider” (processor) and processes the data only to provide the Service under our agreement with the Customer. If you are an End User and have questions about how your information is used, please contact the Aquapio Customer that collected it (see Section 11).

    3. Information We Collect

    Depending on how you interact with us, we may collect the following categories of personal information:

    • Identifiers and contact data: name, business name, email address, phone number, mailing or business address, account username, and similar identifiers.
    • Account and profile data: login credentials, role, preferences, and settings.
    • Commercial and billing data: subscription plan, transaction history, and billing details. Payment-card details are handled by our payment processor; we do not store full card numbers.
    • Customer Data you submit: contacts, leads, messages, calendar events, documents, forms, and other content you upload or generate through the Service, which may include information about your End Users.
    • Communications data: the content and metadata of emails, SMS/text messages, and calls you send or receive through the Service, and your communications with our support team.
    • Usage and device data: IP address, browser type, device identifiers, pages viewed, features used, log data, and approximate location derived from IP.
    • Cookies and similar technologies: as described in our Cookie Policy.

    Sensitive personal information. We do not seek to collect sensitive personal information (such as government identifiers, financial-account login credentials, precise geolocation, or health information) for our own purposes. Please do not submit such information except where the Service expressly supports it.

    4. How We Collect Information

    • Directly from you, when you register, contact us, complete a form, or use the Service;
    • Automatically, through cookies, log files, and similar technologies when you use the Site or Service;
    • From our Customers, when they upload or generate End User data through the Service;
    • From Third-Party Platforms and service providers, such as our payment processor, the underlying software platforms, analytics providers, and integrations you connect.

    5. How We Use Information

    We use personal information to:

    • Provide, operate, maintain, secure, and improve the Service;
    • Create and manage accounts and authenticate users;
    • Process payments, billing, and renewals;
    • Provide customer support and respond to inquiries;
    • Send administrative and transactional messages, and — with any required consent — marketing communications about Aquapio (you may opt out at any time);
    • Monitor usage, prevent fraud and abuse, and enforce our Terms;
    • Produce de-identified and aggregated analytics; and
    • Comply with legal obligations and protect our rights.

    We process End User data only as needed to provide the Service to our Customers and per their instructions, and we do not use it for our own independent purposes except to maintain, secure, and improve the Service as permitted by law.

    6. How We Disclose Information

    We do not sell your personal information for money. We may disclose personal information to:

    • Service providers and sub-processors that perform functions on our behalf, including the software platforms on which the Service is built, hosting and infrastructure providers, payment processors, SMS/telephony carriers, email-delivery providers, and analytics providers — each bound to use the data only to provide services to us;
    • Our Customers, where you are an End User whose data a Customer controls;
    • Professional advisors, such as lawyers, accountants, and auditors;
    • Authorities or others when required by law, to respond to legal process, or to protect the rights, safety, and property of Aquapio, our users, or the public;
    • A successor in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

    7. Sub-Processors

    Platform dependency. The Service is built on and delivered through underlying software platforms. As a result, Customer Data and certain account and usage data are stored and processed within those platforms and their sub-processors' infrastructure, subject to their security and data-handling practices. Other sub-processors may include cloud-hosting providers, payment processors, SMS/telephony and email-delivery providers, and analytics vendors.

    We require our sub-processors to protect personal information and to use it only to provide services to us.

    8. Cookies and Tracking

    We and our providers use cookies and similar technologies on the Site for functionality, analytics, and (where applicable) advertising. For details and your choices, see our Cookie Policy. You can also use browser controls and recognized opt-out preference signals such as the Global Privacy Control (GPC), as described in Section 10.

    9. Data Retention

    We retain personal information for as long as needed to provide the Service, maintain your account, comply with legal obligations, resolve disputes, and enforce our agreements. Customer Data is retained for your subscription term and made available for export for a limited period after termination for 30 days, after which it may be deleted in the ordinary course, subject to backup cycles and legal requirements. We retain End User data on behalf of our Customers per their instructions and our agreement with them.

    10. Your California Privacy Rights (CCPA/CPRA)

    If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you the following rights regarding personal information we hold as a business, subject to verification and legal exceptions:

    • Right to know / access: request the categories and specific pieces of personal information we have collected, the sources, the business purposes, and the categories of recipients.
    • Right to delete: request deletion of personal information we collected from you.
    • Right to correct: request correction of inaccurate personal information.
    • Right to opt out of sale/sharing: we do not sell personal information or share it for cross-context behavioral advertising; if that changes, we will provide a “Do Not Sell or Share My Personal Information” mechanism.
    • Right to limit use of sensitive personal information: to the extent we process sensitive personal information beyond permitted purposes.
    • Right to non-discrimination: we will not discriminate against you for exercising your rights.

    How to exercise your rights. Submit a request to privacy@aquapio.com. We will verify your identity before responding and will respond within the timeframes required by law. You may use an authorized agent to submit a request on your behalf with proof of authorization.

    Opt-out preference signals. Where required, we honor recognized browser-based opt-out preference signals such as the Global Privacy Control (GPC).

    “Shine the Light.” California Civil Code §1798.83 lets California residents request information about disclosure of personal information to third parties for their direct-marketing purposes. We do not share personal information with third parties for their own direct marketing.

    End User requests. If your information was provided to us by one of our Customers (i.e., we act as a service provider), we will refer your request to the relevant Customer or assist them in responding.

    Note: We do not sell or share any of the above categories within the meaning of the CCPA.

    11. End Users of Our Customers

    If you are an End User and your information was collected by an Aquapio Customer (for example, a manufactured-housing dealer, broker, or educator that uses Aquapio), that Customer determines how your information is used and is responsible for providing you with notice and obtaining any required consent. Direct privacy requests and questions to that Customer. Aquapio will support the Customer in responding to verified requests as required by law.

    12. Data Security

    We use reasonable administrative, technical, and physical safeguards designed to protect personal information, and we rely on the security measures of our underlying software platforms and other infrastructure providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your login credentials and for the security practices within your own account.

    13. Children's Privacy

    The Service is intended for business use by adults and is not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, contact privacy@aquapio.com and we will take appropriate steps to delete it.

    14. Data Location and International Users

    Aquapio operates in the United States, and personal information is processed in the United States. If you access the Service from outside the United States, you understand that your information will be transferred to and processed in the United States, where data-protection laws may differ from those in your location.

    15. Third-Party Links

    The Site and Service may link to third-party websites and platforms (including our underlying software platforms and integrations) that we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy notices.

    16. Changes to This Policy

    We may update this Privacy Policy from time to time. The “Last Updated” date above reflects the current version. If we make material changes, we will provide notice as required by law. Your continued use of the Service after changes take effect constitutes acceptance.
